Please read these Terms of Service carefully before using Whalex. By downloading, installing, or using the application, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of Whalex ("App"), operated by VivaThinking ("Company", "we", "us"). By accessing or using the App you confirm that you are at least 13 years old and agree to these Terms.
2. Description of Service
Whalex is an investment intelligence application that provides:
- Institutional investor (13F) portfolio tracking and trend analysis.
- Smart-money overlap and concentration analysis tools.
- Watchlist management and market data visualisation.
- Pro subscription features including extended historical data and advanced filters.
3. Investment Disclaimer
Important: All data and analysis provided by Whalex is for informational purposes only and does not constitute financial, investment, or trading advice. SEC 13F filings are filed quarterly and may reflect positions that are 45–135 days old at the time of publication. Past institutional behaviour is not indicative of future market performance. You should consult a licensed financial advisor before making any investment decisions.
4. Data Accuracy
We source 13F data directly from SEC EDGAR public filings. While we strive for accuracy, we make no warranties regarding the completeness, timeliness, or correctness of the data. Market prices, valuation figures, and percentage calculations are approximations and may differ from official filings due to stock splits, currency conversion, or data processing latency.
5. User Accounts
- You may use Whalex as a guest (anonymous account) or link your Apple/Google identity for cross-device sync.
- You are responsible for maintaining the confidentiality of any linked account credentials.
- You agree not to use the App for any unlawful purpose or in violation of any regulations.
6. Subscriptions and Payments
- Whalex offers a free tier and a Pro subscription ("Whalex Pro").
- Subscriptions are billed through the Apple App Store or Google Play Store. All payment terms, refund policies, and billing cycles are governed by the respective platform's terms.
- Subscription prices are displayed in the App prior to purchase and may vary by region.
- Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current billing period via your platform account settings.
7. Intellectual Property
All content within the App, including but not limited to code, design, icons, analysis algorithms, and UI elements, is the property of VivaThinking and is protected by applicable intellectual property laws. SEC 13F filing data is in the public domain but our processing, categorisation, and presentation thereof remains our proprietary work product.
8. Prohibited Conduct
You agree not to:
- Scrape, reverse-engineer, or extract data from the App without written consent.
- Use the App to distribute market manipulation content.
- Attempt to gain unauthorised access to our servers or other users' accounts.
- Resell or sublicense access to App features or data.
9. Limitation of Liability
To the maximum extent permitted by law, VivaThinking shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to financial losses resulting from investment decisions made based on data or analysis provided by Whalex.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which VivaThinking operates, without regard to conflict of law provisions.
